Saving texts as evidence for custody

To preserve texts for a custody matter, keep the original conversation and save a readable copy showing sender, date, time and surrounding context. Avoid editing message content or presenting a cropped fragment as the whole exchange. Connect relevant messages to a dated log, and ask your attorney about authentication, privacy and local evidence requirements.

Steps to keep a usable record

  1. 1. Preserve the original

Keep the conversation on the device or account where you received it when possible. Do not access someone else’s account or device without authorization.

  2. 2. Save context and dates

Use an available conversation export or clear screenshots. Include the relevant surrounding messages, participants and timestamps; note any missing material.

  3. 3. Label copies accurately

Keep originals separate from highlighted review copies. Name the file with the date range and conversation participants.

  4. 4. Link and review

Reference the saved file from a factual entry. Let your attorney decide whether and how to present it under local evidence rules.

Worked example

Sample only: a thread from October 6, 4:40–5:25 p.m. includes the exchange-location confirmation and arrival message. Exhibit 3 preserves that context. The log cites the thread rather than changing a message to make it sound clearer.

Official sources and local rules

State court self-help information is a starting point. These California resources illustrate court preparation, not nationwide rules. Find your own state and local court’s instructions; custody matters generally use state courts, and filing, service and evidence requirements vary.

How to do this in Custody Ninja

Import a thread in Messages and review it before saving. Upload original screenshots or exports to Papers, then cite their exhibit numbers in the related journal entry. The app does not access the other parent’s phone.

Scout is free. They never get a login.

Questions parents ask

Are screenshots automatically admissible?

No. Courts apply evidence rules and may require foundation or authentication. Ask your attorney about your records.

Can I highlight a copy?

Keep an unchanged original. Clearly label any highlighted copy, and do not change the message text or imply missing context never existed.
